Terms of Service

1. Agreement

By accessing or using DischargeIQ ("the Platform"), you agree to be bound by these Terms of Service. The Platform is provided by DischargeIQ Ltd, a company registered in England and Wales. If you are using the Platform on behalf of an NHS Trust or other organisation, you represent that you have authority to bind that organisation.

2. Platform Description

DischargeIQ is an AI-powered clinical decision support tool for hospital discharge coordination. It provides predictive analytics, task management, and operational intelligence. The Platform does not replace clinical judgement and all AI-generated recommendations must be reviewed by qualified clinical staff before acting upon them.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You must not share login details. Organisation administrators are responsible for managing user access and ensuring only authorised staff have access to clinical data. You must notify us immediately of any unauthorised access.

4. Acceptable Use

You agree to use the Platform only for its intended purpose of clinical discharge coordination within your NHS organisation. You must not attempt to access data belonging to other organisations, reverse-engineer the Platform, or use it to store directly identifiable patient information beyond the anonymised identifiers provided.

5. Data Processing

DischargeIQ processes data in accordance with our Privacy Policy and applicable data protection legislation including UK GDPR and the Data Protection Act 2018. A Data Processing Agreement is available for subscribing organisations.

6. Clinical Disclaimer

The Platform provides decision support tools and predictive analytics. These are not medical advice. All discharge decisions must be made by qualified clinical professionals exercising their independent clinical judgement. DischargeIQ Ltd accepts no liability for clinical decisions made based on Platform outputs.

7. Intellectual Property

All intellectual property rights in the Platform, including software, algorithms, designs, and content, belong to DischargeIQ Ltd. Your organisation retains ownership of all clinical and operational data entered into the Platform.

8. Limitation of Liability

To the maximum extent permitted by law, DischargeIQ Ltd's total liability under these Terms shall not exceed the fees paid by your organisation in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages.

9. Termination

Either party may terminate these Terms with 30 days' written notice. Upon termination, your organisation's data will be exported and deleted within 90 days, subject to legal retention obligations.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
